Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Epismo Pte. Ltd. ("the Company", "we", "us", or "our") governing your access to and use of our mobile/web applications and any related services provided (collectively, the “Service”).

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

Account Registration

To access the Service, you must create an account and provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or breach of security.

Payment Terms

Payment Method

All payments for the Service must be made using Stripe, our authorized third-party payment processor. By submitting your payment information, you expressly authorize us to charge the selected payment method for all applicable subscription fees associated with your chosen plan.

Billing Cycle

The initial payment will be processed immediately upon placing your order. Recurring subscription fees will be charged automatically on the same calendar day of each subsequent month. You agree to maintain accurate, valid, and up-to-date billing information to ensure uninterrupted access to the Service.

Service Activation and Suspension

The Service will be provisioned and made available to you once your payment has been successfully processed. In the event of a failed or declined payment, your access to the Service may be temporarily suspended. Service will be restored promptly upon successful completion of payment.

Refunds

Unless required by applicable law, all fees paid are non-refundable. We do not issue refunds for partial use, unused time, or plan changes. In the event you cancel your subscription, any applicable prorated refunds will be handled automatically by Stripe in accordance with their policies. We do not process refunds manually.

Cancellation Policy

You may cancel your subscription at any time through your account settings. Upon cancellation, a prorated adjustment will be calculated based on the remaining portion of your current billing cycle. If the adjustment results in a credit, the amount will be applied to future invoices. If the adjustment results in a balance due, the outstanding amount will be charged in the next billing cycle.

Cancellation does not relieve you of any payment obligations incurred prior to the effective date of termination. All fees accrued up to the cancellation date remain payable.

Acceptable Use

You agree not to misuse the Service. Prohibited activities include, but are not limited to:

  • Using the Service for any unlawful or fraudulent purpose;
  • Attempting unauthorized access to the Service or related systems;
  • Interfering with the functionality or performance of the Service;
  • Reverse-engineering, copying, or reselling any part of the Service without prior written consent;
  • Exceeding usage limits or abusing API access as defined by your plan.

Violation of this section may result in immediate suspension or termination of access without notice.

Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without cause, including but not limited to your breach of these Terms. Upon termination, your license to use the Service shall immediately cease.

Intellectual Property

All content, software, algorithms, and related materials provided as part of the Service are owned or licensed by the Company and are protected by intellectual property laws. No rights are granted to you other than those expressly stated in these Terms.

Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any output generated by our AI will be accurate or appropriate for your purposes.

Limitation of Liability

To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, revenue, data, or business opportunity, arising from or related to your use of the Service, whether based on contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages. In no event shall our total liability exceed the amount you paid to us in the preceding twelve (12) months.

Modifications

We reserve the right to update or modify these Terms at any time. Material changes will be communicated by posting an updated version on our website and, where appropriate, by notification via email. Continued use of the Service after such changes constitutes acceptance of the revised Terms.
